By accessing or using our services, including but not limited to photography, videography, and related digital media services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use our services.

2. Description of Services

Thomas Cannings Photo & Video offers a range of photography and videography services. These services include, but are not limited to:

  • Wedding photography and videography

  • Portrait and event photography

  • Cinematic highlight videos and multi-camera coverage for videography

  • Post-production editing and digital media delivery

The specific details regarding scope, pricing, scheduling, deliverables, and any package options (such as full day or half day coverage) will be set out in a separate Service Agreement (Photography or Videography Agreement) provided to you, which forms an integral part of these Terms.

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate, complete, and timely information regarding your requirements, event details, and preferences.

  • Secure any necessary permits, permissions, or authorisations required for the photography or videography session or event.

  • Collaborate with us by providing relevant timelines, shot lists, or specific instructions as needed.

Failure to meet these responsibilities may result in delays, rescheduling, or cancellation of services.

4. Service Agreement

A binding service agreement will be formed once the scope, schedule, and pricing of the services have been agreed upon. This agreement may be in the form of a written contract, email correspondence, or another mutually accepted format, and will incorporate:

  • Detailed terms for photography and/or videography services (as applicable)

  • Payment terms and conditions, including any booking fees, deposits, and liquidated damages provisions

  • Cancellation policies

  • Intellectual property rights and usage details

By entering into a service agreement with us, you acknowledge and agree that its terms form part of these Terms of Service.

5. Payment and Cancellation

Payment terms and conditions will be outlined in the individual service agreement. Generally:

  • A non-refundable booking fee is required to secure your date.

  • The remaining balance is due as specified in your service agreement.

  • In the event of cancellation, you may be subject to cancellation fees or forfeiture of the booking fee in accordance with the agreed liquidated damages provisions.

For detailed payment and cancellation terms, please refer to the Photography/Videography Agreement applicable to your service.

6. Intellectual Property Rights

Unless otherwise agreed in writing:

  • All intellectual property rights, including copyrights, in the raw and edited images and video footage remain with Thomas Cannings Photo & Video.

  • You are granted a non-exclusive licence for personal use of the delivered media.

  • We reserve the right to use your images and footage for promotional purposes, portfolio showcasing, and marketing, unless you provide written instructions otherwise prior to the event.

7. Limitation of Liability

To the extent permitted by applicable law, Thomas Cannings Photo & Video shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with our services. This includes, without limitation, any loss of data, loss of profit, or personal injury, except in cases of gross negligence or wilful misconduct.

8. Indemnification

You agree to indemnify, defend, and hold harmless Thomas Cannings Photo & Video, its employees, agents, and subcontractors from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with:

  • Your use of our services

  • Any breach of these Terms or the Service Agreement by you

  • Any violation of any rights of a third party

9. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice. We may also update these Terms periodically. The updated version will become effective upon posting on our website, and it is your responsibility to review the Terms regularly.

10. Governing Law and Jurisdiction

These Terms, and any disputes arising out of or related to them or the provision of our services, shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts in the United Kingdom.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and any separate Photography or Videography Service Agreements you enter into with us, constitute the entire agreement between the parties with respect to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether oral or written.
